Brenda Barton-LeMay is an accomplished litigator with over 25 years of experience litigating a broad range of complex business and commercial disputes in California state and federal courts, including breach of contract, unfair competition and other business torts, shareholder disputes, patent infringement, accountant malpractice, real property disputes, lender liability, fraud and bankruptcy litigation.  Brenda is also experienced in appeals and appellate writ proceedings, pre-judgment remedies and post-judgment collection, and alternative dispute resolution.  She has first, solo and second chaired civil and commercial litigation trials (bench and jury).  Brenda is known for her exceptional legal analysis, writing and advocacy skills.

Significant matters and accomplishments

  • Obtained jury verdict awarding client 50% of the estate of famous American artist consisting of artwork and intellectual property rights valued at over $10 million
  • Successfully tried a judicial foreclosure action on behalf of a major American bank, defeating the defendant's defense that the bank had agreed to modify the loan documents by accepting a deed in lieu of foreclosure
  • Represented California Insurance Commissioner in professional negligence action against accountants for insolvent insurer resulting in two published decisions by appellate court establishing Commissioner's standing to assert auditor negligence claims
  • Proposed resolution to California State Bar Conference of Delegates revising CCP § 2025(t) so that "one deposition rule" is not applied to depositions taken under attachment statute was enacted by California State Legislature in 1995


An avid music lover and pianist who listens far better than she plays, Brenda can be found at live music venues and festivals on a regular basis.  She enjoys skiing, hiking, biking, and camping with her husband, daughters and dog, Scout.  Brenda has been a Girl Scouts Troop Leader for over 10 years, and is the Treasurer of the Service Unit to which her Troop belongs.
